Terms of Service

By accessing or using Evalitix (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

We reserve the right to update these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms.

Recruiting organizations (“Admins”) are responsible for:

• Maintaining the confidentiality of their account credentials.
• All activity that occurs under their account.
• Ensuring their use of candidate data complies with applicable data protection laws.
• Promptly notifying us of any unauthorized access or security breach.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Upload or submit malicious files, malware, or content designed to disrupt the Service.
• Attempt to gain unauthorized access to other users' data, accounts, or systems.
• Use automated tools (bots, scrapers) to access candidate data without authorization.
• Submit false, misleading, or fraudulent candidate information.
• Reverse engineer, decompile, or extract the source code of the Service.

The Service uses artificial intelligence to evaluate candidate submissions and generate scores, strengths, and gaps. While we strive for accuracy:

• AI-generated evaluations are advisory only and should not be the sole basis for hiring decisions.
• We make no guarantees about the accuracy, completeness, or fairness of AI evaluations.
• Human review of AI outputs is strongly recommended before making employment decisions.

The Evalitix platform, including its name, logo, design, codebase, and documentation, is the intellectual property of Evalitix. You may not copy, modify, or redistribute any part of the Service without explicit permission.

Candidate-submitted content (resumes, CV data) remains the property of the respective candidates. By submitting content, candidates grant the recruiting organization a license to review and evaluate their application.

To the fullest extent permitted by law, Evalitix shall not be liable for:

• Any indirect, incidental, or consequential damages arising from use of the Service.
• Hiring decisions made based on AI-generated evaluations.
• Data loss, service interruptions, or security breaches beyond our control.
• Actions of third-party services (Google Cloud, Vercel, AI providers) used by the platform.

Our total liability for any claim shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

We reserve the right to suspend or terminate access to the Service for any account that violates these terms, without prior notice.

Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period as required by law or for legitimate business purposes.

These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal.
